SBTC Helps Trucker Beat Alleged “Obstruction of Justice” Charge

The chairman and CEO of a non-profit transportation industry trade group (http://www.smalltransportation.org) called the Small Business in Transportation Coalition ("SBTC"), James Lamb, announced on March 2, 2015 that a Georgia judge has dismissed an "obstruction of justice" charge (Catoosa, GA Docket 2014-SU-CR-330) against interstate trucker and SBTC-member Kenneth Ahearn Capell, who was arrested by Georgia Motor Carrier Officer Leigh A. Parsons in April 2014. Lamb advised Capell told him that Parsons woke Capell, who was duly engaged in DOT-mandated sleep, twice at a Georgia weigh station in a three week period to conduct DOT inspections and arrested Capell alleging "obstruction of justice" when he refused to wake up the second time.
